Alcohol, Tobacco and Funky BO Policy
This policy does not apply to private bookings.
Escape rooms inherently place people in close proximity to others under sometimes confined, intense conditions.
In the interests of guest comfort, safety and enjoyment, Lost Cruses continually maintains positive pressure airflow conditions throughout all of its gaming environments.
Despite such measures, guests playing with other parties in publicly booked rooms who bear alcohol, tobacco, food, fragrance, hygiene or other odors deemed unusual, overwhelming or unacceptable by other players or management will so be advised and offered the opportunity to address such conditions prior to the scheduled start of play or upon such reporting and to the satisfaction of management. If unable to do so, they may be provided a written copy of Lost Cruces's ATF and / or Olfactory Neutrality policy/ies and may be offered a discounted rescheduling opportunity. -
Refunds
Refunds or other considerations may be extended if Lost Cruces is responsible for delivering services other than as promised and outside of reasonable allowances. They are not offered in cases of:
- Government-mandated suspension of business operations
- Late or no-show
- Solving early
- Expiration of time
- Grumpiness, frustration or not enjoying the experience
- Non-compliance
Refunds are only issued by bank check and may require ten business days for mailing.

Cancellations, Reschedulings, No-Shows and Transfers

Private games by appointment and private events carry a 50% cancellation fee. (This item temporarily not in effect)
Any game may be transferred to any other person at no cost if the transfer is an exact substitution for any previously-booked game. The recipient of the transfer must acknowledge Lost Cruces terms of service prior to play. These transfers may be made at any time.
Any game may be transferred to any other person with a 50% transfer fee if the transfer is into a future game. The recipient of the transfer must acknowledge Lost Cruces terms of service prior to play. -
ADA, claustrophobia, epilepsy, mobility, autism or other health conditions
All 33 self-declared claustrophobics who have participated in both of our escape rooms since our July 2017 opening through this 5/3/2020 update have reported no medical events nor were any observed. They consistently comment afterwards that they were so immersed and engaged in the game that they never felt distressed, hot or confined. They felt in control knowing they could leave at any time just by pushing a button and walking out of the room. None of them felt any sense of confinement or distress. If you don't feel comfortable in the space, let us know as soon as you don't feel right and we'll work together on a solution. Remember - you never need to disclose or discuss personal health details with us - you never need to declare a reason to leave the room - and you never need to ask for permission to leave the room.
Lost Cruces is designed and operated as an all-access facility. All persons are welcome and encouraged to play. Please contact us ahead of time so we can learn more about your requests and inform you of our environments and procedures to allow you to make an informed decision if Lost Cruces is right for you. No person is ever asked or obligated to disclose personal health details. Participation constitutes acceptance of Terms of Service and Assumption of Risk.

Interpretation of Time
Lost Cruces abides by a Monochronic, Time-Certain Schedule. The output returned from time.gov is accepted as 'time'. Games starting late for Lost Cruces causes are excluded from the following policy:
All games end at their scheduled ending time. Games may start marginally late upon unanimous consent of all affected players present at the scheduled start of play. Games so started will end at their scheduled ending time and will not entitle affected players to considerations. -
Prohibited Items and Actions
The following are prohibited on Lost Cruces property – which includes exterior accessways and parking surfaces. Non-compliance is cause for irrevocable ejection, banishment and barring and applicable civil and / or criminal prosecution:
- Consumption of alcohol
- Consumption or possession of drugs not legal or medicinal
- Posession or use of illegal paraphernalia
- Use of any form of tobacco products
- Use of devices capable of vaporizing liquids
- Illegal actions or threats thereof
- Harassing, bullying, exploitative, predatory, stalking or abusive actions or threats thereof
- Use of Lost Cruces technology in the commission of a crime or violation of a policy
The following are prohibited within Lost Cruces:
- Weapons of any kind or category or facsimiles thereof
- Open flames
- Consumption of alcohol

Impairment
Guests exceeding the following BAC maximums or those declining to submit to management- administered assessments may be denied access and / or service and may be offered a discounted rescheduling opportunity. This policy applies to persons affected by medicinal causes.
To be eligible to play,Your BAC must be below: If you are: 0.08% 21 + 0.02% Under 21 On a lighter note here ... Research has proven that heavily intoxicated players rarely enjoy escape rooms. They become lethargic, lose coordination, annoy other players and just don't have the brain power needed to think their way forward through the games – which is where the fun comes from. Many, many people think it's much, much more fun to play first and then celebrate afterward.
We're not talking about players who have a beverage or two before play. We're talking about players who stumble in with both eyes in the same socket ... Please consider our experience and friendly advice in the interest of your enjoyment of Lost Cruces.

Language of Business
All matters of business and play are conducted in written and spoken English at this time. Lost Cruces welcomes all players to our inclusive environment and looks forward to offering services in additional languages in the future.

Gift Certificates, Prizes, Promo Codes, Vouchers and other Gift Items
Expired Gift Certificates, Prizes, Promo Codes, Vouchers and other Gift Items may be redeemed after their expiration dates, but are recognized at 50% of their value. -
Dress and Artifacts
Head coverings interfering to any extent with participant recognition viewed from any angle are prohibited.
Baseball hats are prohibited.
Apparel, visible tattoos and / or artifacts thereupon deemed unacceptable by management are prohibited. Persons observed or suspected to be non-compliant with this policy will so be advised and offered the opportunity to address the matter prior to the scheduled start of play and to the satisfaction of management. If unable to do so, they may be denied access and / or service and may be offered a discounted rescheduling opportunity. -
Breakage and Shrinkage
Damage or loss to Lost Cruces property caused by incidental actions or normal wear and tear are excluded from this policy:
Damage or loss to Lost Cruces property or that of any affiliate caused by actions not compliant with the Terms of Service are billable to and accepted by the responsible party as the sum of procurement, labor, 100% of lost revenue capacity for the duration of incapacity and administrative costs. -
Directives and Advisements
Directives and advisements issued by Lost Cruces employees or agents by any means amend and supersede prior-stated Terms of Service.

Debt Recovery
Responsible Parties and Participants jointly accept uncontested responsibility for reimbursing Lost Cruces and / or its agents for all postal, filing, adminstrative, fee, lost opportunity and otherwise associated costs associated to any extent and in any manner with Lost Cruces debt recovery efforts arrising out of non-payment in any form for any reason. This includes unfounded or fraudulent chargebacks or the initiation of a chargeback prior to contacting Lost Cruces Escape Room.

Assumption of Risk
Participation in any aspect of Lost Cruces Escape Room activities is voluntary and bears potential risks – not all of which are foreseeable or preventable. Risks include but are not limited to death, disability, personal injury, property damage, property theft, virul or bacterial infection, contraction of a communicable disease, abnormalities of a mental, psychological, emotional or behavioral nature or conditions arising at any future time.
Participation, for one's self and those of their party, expressly constitutes acceptance of Assumption of Risk as defined herein and by all applicable law, and for each participant's self, executors, administrators, agents, heirs, next of kin, successors and assigns; perpetually and globally waives, releases and discharges from any and all liability, including but not limited to liability arising from the negligence or fault of the entities or persons herein released; and indemnifies, holds harmless and demonstrates covenant not to litigate against any and all Lost Cruces Escape Room directors, officers, owners, employees, volunteers, representatives, suppliers or agents of any form.
Participation expresses acceptance of and truth that:- Participant physical and / or mental conditions that compromise safety are absent.
- Participant impairment by drugs or alcohol is absent.
- Application by Lost Cruces Escape Room of the letter and spirit of this policy will govern
participant actions and responsibilities. - Lost Cruces Escape Room may determine if unsafe conditions or behaviors exist and may elect
to continue, modify or terminate participation at its sole discretion, which may include
participant removal from the premises by any lawful means. - Lost Cruces Escape Room bears no responsibility for errors, omissions, acts, or inaction by any
entity conducting any activity on its behalf. - Medical treatment will be sought in the event of injury, accident, and / or illness arising out of
participation. - This policy shall be construed broadly to provide release and waiver benefit to the maximum
extent permissible by New Mexico and any law applicable within a court of competent jurisdiction.
